Ukraine: Cosmetic products legislation is to be harmonized with the EU requirements

Ukrainian manufacturers and importers of cosmetic products will have to comply with the new Technical Regulation on Cosmetic Products once it is adopted. Draft TR on Cosmetic Products has been harmonized with the EU Regulation on Cosmetic Products EC No. 1223/2009.

The proposed date as of which the draft TR is to become compulsory for all cosmetic products manufactured in Ukraine or placed on the Ukrainian market is 1 January 2017.

Draft TR on Cosmetic Products sets out the obligations of the responsible persons: the manufacturer and the importer (authorized representative). A distributor will become a responsible person if they place cosmetic products on the Ukrainian market under their name or trademark or if they modify cosmetic products which have already been placed on the market in a way that may affect compliance of the products with the Technical Regulation on Cosmetic Products.

Cosmetic products are to be manufactured with the use of Ukrainian national standards which are identical to the harmonized EU standards.

Responsible persons will be required to keep the dossier for their product.

Before a cosmetic product is placed on the Ukrainian market, the responsible person is required to submit a notification (in an electronic form) to the Ministry of Healthcare of Ukraine.
