As of 1 November 2018, products included into the lists adopted by Direction No. 2322-r of 27 October 2018, will not be subject to any circulation restrictions that are applicable to ethanol-containing products.
Two product lists were adopted: one based on the internal Russian product nomenclature (OKVED) and based on the EAEU product nomenclature used for external economic activities (TN VED). However, although different customs codes are indicated in each list, products types in both lists are essentially the same.
An “ethanol-containing” product is a food or non-food product with the content of ethanol over 0,5% of the volume of the whole finished product.
The circulation of ethanol-containing products in Russia is subject to a number of restrictions. For example, sale of ethanol-containing non-food products via vending machines is prohibited. Also, all ethanol-containing non-food products must contain a warning that internal use of these products is hazardous for human life and health. The warning must be on the front label and occupy at least 10% of the label size (except for perfumery and cosmetic product labels). Restrictions on the circulation and production of ethanol-containing products are set by Federal Law No. 171-FZ of 22 November 1995 (as amended).
The lists of products not subject to Federal Law No. 171-FZ of 22 November 1995 specify the maximum size of consumer packaging that is required in order to be exempt from the mentioned restrictions and include:
- Perfumes and eau de toilette (up to 150 ml);
- Cosmetic products, make up or skincare products (including self-tan products, manicure and pedicure products (up to 250 ml);
- Hair care products (up to 500 ml);
- Oral and tooth hygiene products (up to 300 ml);
- Shaving, after shave and pre-shave products, deodorants, antiperspirants and similar products (up to 250 ml);
- Room air fresheners (up to 1000 ml);
- Skin cleansing products in a liquid or cream form, packaged for retail sale and whether or not soap-containing (up to 5000 ml);
- Artificial and other prepared wax (up to 500 ml);
- Shoe wax, polish and other similar shoe and leather care products (up to 750 ml);
- Polishers and other similar products used for wood furniture and floor care as well as other wooden products (up to 3000 ml);
- Ready made glues (up to 500 ml).
