Russia: Proposed risk-oriented approach for state environmental inspections

The Ministry of Natural Resources and Ecology published draft decree that would regulate state environmental inspections. According to the draft Decree proposed by the Ministry of Natural Resources and Ecology, all organisations are to be assigned an environmental risk category. The draft Decree sets out criteria for assigning any organization to an environmental risk category.

The purpose of assigning an environmental risk category is to determine the frequency of scheduled environmental inspections for each organization. Thus, any organization assigned to an extremely high risk category will be inspected once a year. An organization that has been assigned to a high risk category – once every two years, an organization assigned to a significant risk category – once every three years, an organization assigned to a medium risk category – no more often than once every three years and any organization assigned to a moderate risk category – no more often than once every four years. If an organization is assigned to a low risk category – it will not be subject to scheduled state environmental inspections at all.

 

An environmental risk category set for an organization may be increased or lowered by the environmental authorities, depending on how likely the organization in question is to breach environmental regulations.
