As of 22 May 2018, the Ukrainian Technical Regulation on the restriction of the use of certain hazardous substances in electrical and electronic equipment (“the Ukrainian RoHS) was amended. The amendments move forward or remove expiration dates for a number of uses of hazardous substances in electrical and electronic equipment. The amendments also clarify that expiration dates for some exemptions are to be set by the Cabinet of Ministers of Ukraine.
For example, the expiration dates for the use of mercury in in single capped (compact) fluorescent lamps for general lighting purposes ≥ 150 W is 15 mg per burner have been removed. The expiration date may be subsequently set by the Cabinet of Ministers. Expiration dates for the exemption for the use of Mercury in metal halide lamps and for the use of Mercury in other discharge lamps for special purposes not specifically mentioned have also been removed until the Cabinet of Ministers sets such dates.
The same has been done for the exemption applicable to lead in glass of fluorescent tubes not exceeding 0,2 % by weight and to the use of lead as an alloying element in steel for machining purposes and in galvanised steel containing up to 0,35 % lead by weight.
Expiration dates have also been removed for the exemption of copper allows containing up to 4% of lead by weight.
The removal of the expiration dates means that manufacturers and importers will continue to be able to sell in Ukraine products which quality for one of such exemptions until the Cabinet of Ministers sets the relevant exemption expiration dates.
