The Ministry of Social Policy has issued a clarification letter reminding that any enterprise with 50 or more employees must establish an internal labor protection service (OHS service) in accordance with the Model Regulation on the labor protection service adopted by Order No. 255 of 15 November 2004.
In an enterprise with fewer than 50 employees, the functions of the labor protection service can be performed by employees also performing other functions provided these employees have received the relevant training.
An enterprise with a less than 20 employees may contract third-party specialists with appropriate training to perform the functions of the labor protection service (OHS service).
The labor protection service reports directly to the employer (head of the enterprise/facility).
The employer must develop and approve an internal Regulation on the OHS Service, determine the structure of the OHS service, the size of the OHS service as well as its main tasks and duties, based on the Model Regulation on the labor protection service and taking into account the specifics of production and types of activities, the number of employees, working conditions and other factors.
