EAEU: Adopted Technical Regulation on the safety of packaged drinking water

As of 1 January 2019 producers and importers of drinking water in packaging (including natural mineral water) are required to comply with the provisions of the adopted Technical Regulation on the Safety of Packaged Drinking Water, Including Natural Mineral Water, TR EAEU 044/2017 (the “TR”).

The adopted TR applies to packaged drinking water released into circulation into the EAEU and intended for the distribution to end users, including the following drinking water:

  • Natural mineral water (including table mineral water, therapeutic-table mineral water and therapeutic mineral water);
  • Blended mineral water;
  • Natural drinking water;
  • Treated drinking water;
  • Drinking water intended for children; and
  • Artificially mineralized drinking water.

The TR also applies to the production process, storage, transportation, distribution and utilization of packaged drinking water.

The TR requires to place the EAEU conformity mark (the EAC mark) on all packaged drinking water that complies with the TR requirements.

Manufacturers and importers of packaged drinking water (except for packaged drinking water intended for children, therapeutic-table and therapeutic drinking water) are required to issue a conformity declaration. Conformity assessment may be performed by using modules 1d, 2d, 3d, 4d and 6d.

Manufacturers and importers of packaged drinking water intended for children, therapeutic-table and therapeutic drinking water are required to obtain a state registration certificate.
