Ukraine: Proposed Technical Regulation on Safety of Toys

Manufacturers and importers of toys may soon have to comply with the safety requirements that would be imposed by the draft Technical Regulation on the Safety of Toys. The draft Technical Regulation on Safety of Toys was proposed on 29 August 2017 and has been developed on the basis of the provisions of the EU Directive on Safety of Toys (“the Toys Directive 2009/48/EC”).

Ukraine: Revised rules for the development of occupational health and safety instructions

When the Rules enter into force, all employers will be required to follow them when developing their internal occupational health and safety instructions. The Rules were adopted by Order No. 526 of 30 March 2017 and will enter into force from the date of their official publication. As at 21 August 2017, the Order has not been officially published.

Ukraine: What are the revised RoHS requirements?

The revised Ukrainian Technical Regulation on the restriction of hazardous substances in electrical and electronic equipment enters into force on 22 September 2017. It is therefore important for all EEE manufacturers and importers to ensure that they are fully ready to comply with the new requirements imposed by the "Ukrainian RoHS". The revised Ukrainian RoHS was developed in line with the EU RoHS recast provisions subject to certain deviations.

Transitional period

Ukraine: Proposed revised format for certification body identification

On 27 July 2017 the Cabinet of Ministers of Ukraine (Department of Technical Regulation) published draft Decree that would amend Decree No. 1184 on the format of the national conformity mark.

The amendments would clarify in which format the relevant conformity assessment body number is to be indicated next to the national conformity sign of Ukraine. 

Ukraine: Adopted Law on Environmental Impact Assessment

As of 18 December 2017, organisations planning any activity that is capable to significantly impact the environment, are required to perform an Environmental Impact Assessment (EIA) subject to the requirements imposed by Law adopted on 23 May 2017.

Ukraine: Increasing penalties for breaches of food and feedstuffs safety legislation

As of 4 April 2018 food and feedstuffs manufacturers and suppliers (including importers) are required to comply with the adopted law on enforcement of safety legislation applicable to these products.

The adopted law regulates state supervision measures that are to be taken in a form of audits, inspections, sample taking, laboratory tests and analysis, visual inspection and documentary inspection.

Ukraine: Approved Technical Regulation on Radio Equipment

Starting from 1 April 2018 all manufacturers and importers of radio equipment in Ukraine are required to comply with the adopted Technical Regulation (TR) on the safety of radio electronic equipment, subject to the set transitional period. The adopted TR is in line with the European Directive 2014/53/EU relating to the making available on the market of radio equipment.
